These Terms & Conditions govern access to and use of the Winnie’z websites, applications, portals, and related services (collectively, the “Platform”). The Platform is provided by Winniez Care, based in Cairo, Egypt (“Winnie’z,” “we,” “us,” or “our”).
By creating an account, accepting an invitation, accessing the Platform, or continuing to use it, you agree to these Terms. If you use the Platform on behalf of a school, provider, organization, employer, or other legal entity, you confirm that you have authority to accept these Terms on its behalf.
1. What Winnie’z Provides
Winnie’z is a role-based coordination and developmental-support platform. It helps authorized families, providers, school providers, supervisors, quality teams, administrators, and trainees organize and communicate about goals, observations, sessions, attendance, reports, meetings, messages, progress, training, and related support activities.
Features and access differ by role, organization, subscription, and assigned permissions. We may improve, replace, or discontinue features where reasonably necessary, subject to any applicable customer agreement.
2. The Platform Does Not Replace Professional Judgment
Winnie’z supports communication, documentation, coordination, and oversight. It does not provide a medical diagnosis, clinical treatment, emergency service, or a substitute for qualified professional judgment.
Information shown through the Platform should be considered alongside the child’s individual circumstances and the judgment of authorized professionals and guardians. If a child may be in immediate danger or requires urgent medical help, contact the appropriate emergency service or safeguarding authority directly. Do not rely on the Platform for emergency communication.
3. Eligibility and Authority
You may use the Platform only if you are legally able to enter into these Terms or are using it under a valid agreement and authorized supervision.
Adults who add, manage, or authorize information about a child confirm that they have the appropriate parental responsibility, legal authority, professional responsibility, or organizational permission to do so. Organizations are responsible for confirming the authority and role of the users they invite.
Children must not create or operate independent accounts unless Winnie’z and the responsible adult or organization have expressly authorized an age-appropriate experience.
4. Accounts and Access
You must provide accurate account information and keep it reasonably current. You are responsible for protecting your password, verification codes, devices, and account access.
You must not share an account between users or allow another person to use your credentials. Notify us promptly at hi@winniez.net if you believe an account or device has been compromised.
Access is assigned according to role. You must not attempt to view, collect, change, export, or disclose information beyond the permissions given to you.
5. Appropriate Use
You agree to use the Platform lawfully, respectfully, and only for authorized support, educational, administrative, quality, or training purposes.
You must not:
Access information without a legitimate and authorized need
Upload information you are not entitled to use or disclose
Misrepresent your identity, role, qualifications, or relationship to a child
Harass, threaten, exploit, discriminate against, or endanger another person
Use information to stigmatize, punish, exclude, or unfairly profile a child
Copy, scrape, sell, or commercially exploit Platform data without written permission
Introduce malware or interfere with the Platform’s security or availability
Reverse engineer or attempt to discover non-public source code, except where the law expressly permits it
Use automated tools to extract information or train external systems without our written authorization
Circumvent role-based access, audit controls, or other safeguards
6. Responsibilities of Families and Organizations
Families, schools, providers, and organizations remain responsible for the accuracy and appropriateness of the information they submit and for the professional, safeguarding, and operational decisions they make.
Organizations are also responsible for:
Assigning users the correct roles and permissions
Removing access when a person changes role or leaves
Training users on confidentiality and appropriate use
Obtaining notices, permissions, or consents required for their activities
Responding appropriately to safeguarding, professional, or legal concerns
Using reports and progress signals with suitable human review
7. Child and Support Information
Information about a child may include sensitive personal and support-related details. Users must handle it with particular care and only within the authorized circle of support.
You should record information that is relevant, respectful, proportionate, and written in professional language. Do not include unnecessary allegations, discriminatory descriptions, or unrelated personal information.
Confidential incident reports, internal professional notes, and family-facing updates may have different access rules. You must respect the classification and intended audience shown within the Platform.
8. User Content
You or your organization retain ownership of information, notes, messages, documents, and other material submitted to the Platform (“User Content”).
You grant Winnie’z a limited right to host, process, reproduce, transmit, secure, back up, and display User Content only as reasonably necessary to operate, support, protect, and improve the Platform; meet our legal obligations; and perform applicable customer agreements.
You confirm that you have the authority to submit the User Content and that its use as described in these Terms and our Privacy Policy does not violate another person’s rights.
9. Privacy and Confidentiality
Our Privacy Policy explains how we handle personal data. It forms part of these Terms.
Every user must preserve the confidentiality of information accessed through the Platform. Confidential information may be shared only with people who are authorized to receive it or where disclosure is required by law or necessary to protect a person from serious harm.
10. Intellectual Property
Winnie’z and its licensors own the Platform, software, design, branding, documentation, templates, and other materials we provide, excluding User Content.
Subject to these Terms and any customer agreement, we give you a limited, non-exclusive, non-transferable, revocable right to use the Platform for its intended purposes. No other rights are granted.
The Winnie’z name, logo, bee character, and related brand elements may not be used without our prior written permission.
11. Third-Party Services
The Platform may use or link to third-party hosting, communication, authentication, analytics, or other services. Third-party services may have separate terms and privacy notices. Winnie’z is not responsible for a third-party service that you choose to access outside the Platform.
Where third parties process personal data for Winnie’z, we require appropriate contractual and security protections in line with applicable law.
12. Availability and Changes
We work to keep the Platform secure and available, but uninterrupted or error-free access cannot be guaranteed. Maintenance, security work, technical failures, internet conditions, or events beyond our reasonable control may affect availability.
We may update the Platform or these Terms to reflect new features, security requirements, legal changes, or business operations. If a change materially affects users’ rights, we will provide reasonable notice through the Platform, email, or another appropriate channel.
13. Suspension and Termination
We may restrict or suspend access where reasonably necessary to protect a child, user, organization, the Platform, or another person; investigate suspected misuse; comply with law; address non-payment under a customer agreement; or prevent a security risk.
You may stop using the Platform at any time. Account closure, data return, and deletion may be subject to the applicable customer agreement, legal obligations, safeguarding requirements, and retention rules.
Provisions concerning confidentiality, intellectual property, liability, disputes, and any other terms that by their nature should continue will survive termination.
14. Disclaimers
To the extent permitted by law, the Platform is provided on an “as available” basis. Winnie’z does not promise that every report, notification, progress signal, or user-submitted item will be complete, accurate, or suitable for every decision.
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded, including applicable consumer rights.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Winnie’z will not be liable for indirect, incidental, special, punitive, or consequential losses, or for loss caused by unauthorized user conduct, inaccurate User Content, professional decisions made outside our control, third-party services, or failure to follow safeguarding or emergency procedures.
Any financial cap or additional allocation of liability agreed in a written customer contract will apply to that customer. Nothing in these Terms limits liability where limitation is prohibited by law, including liability arising from fraud, wilful misconduct, or other non-excludable responsibility.
16. Governing Law and Disputes
These Terms are governed by the laws of the Arab Republic of Egypt, without prejudice to any mandatory rights that apply in another jurisdiction.
Please contact us first so we can try to resolve a concern. If it cannot be resolved informally, disputes will be subject to the competent courts of Egypt unless an applicable written agreement or mandatory law provides otherwise.
